ClassPassは、お客様のプライバシーの権利を尊重します。本プライバシーポリシーでは、ClassPassがどのような会社であるか、当社及びグループ会社（以下に定義します。）がお客様の個人情報をどのように収集、共有、使用するか、また、お客様がプライバシーの権利をどのように行使できるかについて説明します。

本プライバシーポリシーは、classpass.comのウェブサイトやモバイルアプリケーション（以下、総称して「本サイト」といいます。）、当社が随時提供するその他のサービスに適用されます。お客様の個人情報の使用に関してご質問やご不明な点がある場合は、以下の「お問い合わせ」セクションをご覧ください。

本サイトは、18歳未満の方を対象としたものではなく、また18歳未満の方に向けたものでもありません。当社は、18歳未満の方から、18歳未満であることを承知の上で情報を収集することはありません。本サイトへの登録又はその他の方法で当社に情報を提供する方は、18歳以上の方に限られます。

一定の国々及び米国の一定の州（カリフォルニア州を含みます。）にお住まいの方は、［以下］の「特別条件」セクションに記載されている追加プライバシー通知を必ずご確認ください。

1. ClassPassの業務内容

ClassPassは、当社プラットフォームを通じてフィットネススタジオ、ジム、トレーナー、施設、又はその他第三者（以下「パートナー」といいます。）が提供及び運営するさまざまなフィットネス、レクリエーション、ウェルネスのクラス、サービス又は商品を、利用者（以下「ClassPassユーザー」といいます。）が検索・予約・参加できるようにしています。ClassPassグループ会社（以下、総称して「グループ会社」といいます。）は、世界各地で事業を展開しており、そのうちのひとつがMindbody, Inc.です。Mindbody, Inc.のプライバシーポリシーのコピーは、こちらでご覧いただけます。

2. ClassPassが収集する個人情報

当社は、いくつかの異なる方法で個人情報を収集又は受領します。多くの場合、どのような情報を提供するかはお客様が選択しますが、お客様が本サイトを利用するため、また本サイトを通じてアクセスするサービスを利用するため、また当社がお客様にそれらを提供するために、お客様に特定の情報を要求することがあります。

お客様がClassPassに提供する個人情報

お客様は次のようなさまざまな場面で当社に個人情報を提供します。

アカウントの作成　ClassPassユーザーのアカウントを作成するために、お客様は、お名前、メールアドレス、電話番号、登録都市及びパスワードなどの情報を提供する必要があります。お客様が購入を行うかサブスクリプションに登録する場合は、支払いと請求に関する情報を入力する必要があります。さらに、生年月日、性別、写真、住所などの情報をアカウントに追加することもできます。アカウントを作成するのがパートナーの場合、お名前、住所、電話番号、メールアドレス、クレジットカード情報、納税者番号、及びご自分の事業に関する情報（その事業でクラスやサービスを提供するインストラクター及び個人のお名前、アカウントに登録されている個人のメールアドレスなど）をお伺いします。また、購入履歴や請求情報などの支払い情報を処理し、保存します。　
投稿及びアップロード　当社は、お客様がアンケートに回答したり、クラスの評価やレビューを提供したりする場合など、お客様が本サイトに個人情報を提供、投稿、又はアップロードする際に、お客様から個人情報を収集します。
通信データ　当社は、当社及びグループ会社のサービスや商品に関して、又はパートナーやClassPassユーザーの代わりに、若しくはパートナーやClassPassユーザー発のメッセージをお客様に送信することがあります。例えば、当社は、パートナーが本サイトを通じてClassPassユーザーに次回の予約に関するテキストメッセージやアプリ内メッセージを送信できるようにすることがあります。ClassPassは、このような電話、テキスト、又はその他の通信に関するデータ（通信日時及び通信内容を含みます。）を受信します。
インストラクターのデータ　ClassPassのパートナーは、その事業に所属するインストラクターやその他の個人に関する情報を提供することがあります。ClassPassのパートナーは、インストラクター等に対して自身の情報がClassPassと共有されることを（例えば、本プライバシーポリシーへのリンクを提供する方法で）通知する責任を負います。当社が他者の情報を受領し使用するために必要かつ適切なすべての許可又は同意をその方から得ていない限り、当社に他者の情報を提供しないでください。
第三者データ　ClassPassユーザーは、当社が他者の情報を受領し使用するために必要かつ適切なすべての許可又は同意をその方から得ていない限り、当社に他者の情報（緊急連絡先又は紹介目的など）を提供しないでください。

本サイトの利用により自動的に収集される個人情報

当社は、お客様が（本サイト内外で）コンテンツ又は広告を閲覧又はクリックする、検索を実行する、閲覧する、予約を実行する、モバイルアプリをインストール又は更新する場合など、本サイトを訪問又はその他利用した際に利用データを記録します。具体的には、当社が自動的に収集する情報には、IPアドレス、デバイスの種類、固有のデバイス識別番号、ブラウザの種類、広範囲な地理的位置（国又は都市レベルの位置など）、言語、マーケティング設定及びその他の技術的情報などが含まれる場合があります。また、アクセスしたページやクリックしたリンクなど、お客様のデバイスが本サイトとどのようにやり取りしたかについて情報を収集することがあります。
このほか、お客様がご自分のモバイルデバイスの設定によりClassPassに提供することに同意された場合、当社はお客様のモバイルデバイスに関する正確な位置情報データを収集することがあります。当社は、これらの情報を、サービスの提供、宣伝、改善のため（例えば、お客様の所在地に近いクラスを表示するなど）、また詐欺防止やセキュリティ目的など関連する理由のために使用することがあります。お客様が位置情報データの提供に同意されない場合、モバイルアプリケーションの一部の機能が動作しないことがありますのでご注意ください。

その他の情報源から収集する個人情報

当社は、公的データベース、戦略的パートナー及び共同マーケティングパートナー、SNSページ及びプラットフォーム、SNSプラットフォーム上のお客様の友達又はその他の形でつながっている人、当社グループ会社、及びその他の第三者など、上記以外の情報源からお客様の個人情報を受け取ることがあります。例えば、お客様がFacebookなどの第三者ネットワークとClassPassユーザーのアカウント情報を同期できるように当社が設定している場合、お客様はこれを利用できます。この場合、当社はお客様のFacebookアカウント情報の一部を受け取ります。当社が受け取る情報は、お客様の第三者ネットワークの設定によりますが、通常、お客様のユーザー名、メールアドレス、年齢層、性別、選択言語、国、友達リストなどの基本的な公開プロフィール情報、並びにその他の公開情報を受け取ります。
上記のとおり、パートナーの施設で働くインストラクター又はその他の個人の場合、当社はパートナーからそれらの個人情報を受け取ることがあります。

パートナーから収集するClassPassユーザーに関する個人情報

ClassPassのパートナーは、ClassPassユーザーによるパートナーの施設又はサービスの利用に関するフィードバックを当社に提出する場合があります。

3. ClassPassによる収集した個人情報の使用

ClassPassは、次のような目的のために個人情報を使用します。

本サイト:　本サイト及び本サイトを通じて提供する商品やサービスを運営し維持するため。例えば、当社は、お客様の予約や購入のリクエストに対応するため（支払いの処理、発生したキャンセル料／ノーショー料の請求など）、本サイトでの体験をカスタマイズするため（表示するコンテンツや体験をカスタマイズするなど）、また、利用規約で規定されている目的のために、ClassPassユーザーの個人情報を使用します。当社は、パートナーから提供されたインストラクターの個人情報を、本サイトに掲載するスケジュール（レビューを含みます。）に表示するために使用します。
通信:電子メール、電話、郵便、通知、弊社ウェブサイト又はアプリに表示するプッシュ通知、その他の方法でお客様に連絡するため。弊社では、本サイトの可用性、セキュリティ、カスタマーサービス、又はその他のサービス関連の問題に関するメッセージをお客様に送信します。また弊社は、お客様の通信設定に従って、本サイト、アップデート、リマインダー、プロモーションメッセージに関するメッセージを送信します。このほか、次回の予約に関してパートナー又はClassPassユーザーが開始したメッセージを、パートナー又はClassPassユーザーに代わって弊社がお客様に送信することがあります。お客様はいつでも通信設定を変更することができます。ただし、弊社からのサービスメッセージ（セキュリティに関する通知や法的な通知など）の受信を拒否することはできません。パートナー及び他のサードパーティとのZoomを介した通話中に、弊社はお客様に対しSMSによる追加情報の送信を希望するかどうかを尋ねる場合があります。同意する場合、ご指定いただく電話番号及びオプトインは、マーケティングやプロモーションを目的としてサードパーティのプロバイダー又は関連会社に対し販売、共有されることはありません。
カスタマーサポート:　カスタマーサービスについての問い合わせ等に関連して、苦情やサービスに関する問題の調査、対応、解決などをするため。
ソーシャル:　ClassPassユーザーが他のClassPassユーザーとつながり、また他のClassPassユーザーに発見されるための機能を提供するため。
マーケティング:　マーケティング戦略の策定、電子メール、SMS及び電話によるマーケティングコミュニケーションの送信、第三者のウェブサイトやアプリを通じたデジタルマーケティングのターゲット設定、コンテスト、懸賞、その他のプロモーションの提供、関連する賞品や割引の提供など、当社及び当社グループ会社のマーケティング目的のため。お客様は、下記の「お客様のデータ保護の権利」セクションに記載されているとおり、また、一定の国々及び米国の一定の州（カリフォルニア州を含みます。）の居住者については、下記の「特別条件」セクションに記載されている追加プライバシー通知内に記載されているとおり、当社がお客様に送信するマーケティングに関する選択肢を行使することができます。
研究開発:　調査、分析、記録管理及び報告目的のために、新商品、機能及びアイデアを開発し、試験するため、顧客ベース及び本サイトについて学習するため、並びに本サイト、商品、サービスを発展させ、改善するため。
セキュリティ、調査及び適格性:　お客様の本人確認、詐欺行為のおそれやその他当社の利用規約若しくは本プライバシーポリシーの違反及び／又はClassPassユーザー、本サイト訪問者、パートナーその他の第三者に危害を加えようとする行為の調査若しくは防止を含め、本サイトのセキュリティを維持するため、また、当社が随時実施するプロモーション（無料トライアルなど）に対するお客様の適格性を確認するため。
事業及び運営サポート:　合併、買収、組織再編、破産、及び資金調達などのその他の事業取引を評価し、実施するため。さらには、当社事業、会計、監査、コンプライアンス、記録管理、法務機能を管理するため。
その他:上記の目的以外の収集時に特定した目的又はお客様の同意を得た目的のため。

4. ClassPassによる個人情報の共有

当社は、お客様の個人情報を、以下のカテゴリーの受領者に対して、又は以下の状況において、開示することがあります。

当社にデータ処理及びその他のサービスを提供する（例えば、本サイトの配信をサポートし、その機能を提供し、セキュリティ強化を支援するサービスプロバイダー及び取引先、支払いカード処理業者、カスタマーサポート業者、ホスティング業者、スケジュール管理業者、市場調査及びマーケティング業者）、又は本プライバシーポリシーに記載されている若しくはお客様の個人情報を収集する際に通知する目的のために個人情報をその他の方法で処理するサービスプロバイダー及び取引先に開示する場合。
グループ会社が本サイト及びグループ会社のサービスや商品を提供、開発、改善、及び分析できるようにするため、また、グループ会社独自の社内目的及びマーケティング目的（電子メール、SMS、電話によるマーケティングコミュニケーションの送信、グループ会社のサービスや商品に関するデジタルマーケティングのターゲット設定を含みます。）のために、グループ会社に開示する場合。
お客様がClassPassユーザーとして本サイトを通じて予約又は利用するクラス、アクティビティ又は体験を提供するパートナー及びその第三者プロバイダーが、当該予約又はアクティビティを処理し、お客様にクラスやサービスを提供できるようにするため、当該パートナー及びその第三者プロバイダーに開示する場合。
ClassPassユーザーのアカウントに関連するお客様のお名前、写真、その他の情報は、他のClassPassユーザーがお客様をClassPass上で検索し、つながれるように他のClassPassユーザーに公開されます。他のClassPassユーザーがお客様の検索をできないようにするには、アカウント設定のプライバシータブで設定を更新してください。
お客様がClassPassユーザーのアカウントをFacebookなどの第三者ネットワークに同期させたり、ご自分のモバイルデバイスに保存されている連絡先などの情報を当社に提供したりすると、どの連絡先がClassPassを利用しているかを確認することができます。その連絡先がClassPassの会員である場合、その方にもお客様がClassPassを利用していることが表示されます。
お客様が他のClassPassユーザーからの友達申請を承認した場合、そのClassPassユーザーは、お客様のお名前、写真、その他お客様のアカウントに関連する情報に加え、お客様の過去及び今後参加するクラス、達成バッジ、お気に入りのスタジオ、友達とのつながり、その他のプロフィール情報（以下、総称して「プロフィール情報」といいます。）を閲覧することができます。当社は、広告、オファー、その他ClassPassの友達へのメッセージの一部として又はそれらに関連して、お客様のプロフィール情報を使用、伝達、表示することがあります（例えば、ClassPassの友達にお客様と同じクラスへの参加を勧める電子メールを送信するなど）。このような形でClassPassの友達とプロフィール情報が共有されるのを中止したい場合は、アカウント設定のプライバシータブで設定することができます。
本サイトの公開エリア（施設やスケジュールのリスト、公開プロフィール、レビュー、クラス評価など）にアクセスする訪問者に開示する場合。本サイトの公開エリアでお客様が開示するよう選択したコンテンツや情報は、他のユーザー、一般及び他のサイト（検索エンジンを含みます。）から閲覧、収集、使用できますので、お客様はClassPassユーザーとしてこの旨をご了承ください。
適用法令上、開示が必要であると当社が考える場合、当社の法的権利を行使、確立、弁護するために、又はお客様や他者の重大な利益を保護するために、所轄の法執行機関、規制当局、政府機関、裁判所又はその他の第三者に開示する場合。
実際の又は潜在的な合併、売却、買収、投資、譲渡、組織再編、ジョイントベンチャー、又はClassPassの事業、資産、関連会社若しくはグループ会社の全部若しくは一部の移転（ClassPassが破産申請又は関連手続を行う場合を含みます。）に関連して開示する場合。ただし、当社が該当する第三者に対して、本プライバシーポリシーに記載されている目的に限定してお客様の個人情報を使用することを通知することを条件とします。
お客様が企業向けソリューション又はClassPassコーポレート・プログラムに参加する場合、プログラム管理者（お客様の雇用主又は類似の法人など）に開示する場合。
お客様の同意がある場合又はその他適用法に従って他者に開示する場合。

5. ClassPassによる個人情報の保護

当社は、お客様について収集し、処理する個人情報を保護するセキュリティ手順及び慣行を利用しています。ClassPassでは、脆弱性や攻撃の可能性についてシステムを監視しています。しかしながら、ClassPassは、お客様が当社に送信されるいかなる情報についても、100％安全であることを保証することはできません。

6. 国際的なデータ移転

7. データの保持

お客様から収集した個人情報は、正当な業務上の必要性が継続的にある場合に保持します（例えば、お客様が要求したサービスを提供するため、あるいは、該当する法的、税務、会計上の要件を遵守するためなど）。お客様の個人情報を処理する正当な業務上の必要性が継続的にない場合、当社は個人情報を削除又は匿名化するか、それが不可能な場合（例えば、お客様の個人情報がバックアップアーカイブに保存されている場合など）は、削除ができるようになるまで、お客様の個人情報を安全に保管し、それ以上の処理が行われないようにします。

8. お客様のデータ保護に関する権利

適用法で認められる場合、お客様には以下のデータ保護に関する権利があるかもしれません。

お客様は、以下の「お問い合わせ」セクションに記載されるとおり当社に連絡することにより、個人情報の処理に反対したり、個人情報の処理を制限するよう要求したり、当社が保有する個人情報にアクセスしたり、個人情報のポータビリティを要求したりすることができます。
当社がお客様の同意に基づき個人情報を収集し、処理する場合、お客様はいつでも同意を撤回することができます。お客様が同意を撤回しても、撤回前に当社が行った処理の合法性には影響せず、また、同意以外の合法的な処理理由（該当する場合）に従って行われたお客様の個人情報の処理にも影響を及ぼしません。お客様は、以下の「お問い合わせ」セクションに記載されるとおり当社に連絡することにより、同意を撤回することができます。

10. 本プライバシーポリシーの更新

12. Special Terms (US Residents)

If you are a resident of certain states with comprehensive privacy laws, including but not limited to California, Colorado, Connecticut, Delaware, Iowa, Indiana, Montana, New Jersey, Oregon, Texas, Tennessee, Utah or Virginia, state privacy laws require that we disclose additional information to you about the processing of your personal information and your privacy rights.

Depending on how you interact with us, in the previous 12 months we have collected the categories of personal information from the sources set out at Section 2. We collect this information for the purposes set out at Section 3 and otherwise to accomplish our business and operational purposes (including for audits, helping to ensure the security and integrity of our systems, debugging, the effective operation of our Site and business, internal research and quality purposes), and we may disclose such categories to the third parties set out at Section 4 in furtherance of those purposes. Certain states, such as California, provide residents a right to limit the use of their sensitive personal information. However, we do not engage in uses or disclosures of sensitive personal information that would trigger the right to limit under state law.

To the extent that we are in possession of de-identified data, we commit to maintaining and using de-identified data without attempting to re-identify the data.

We retain your personal information as described under the “Data Retention” section above.

Currently, our Site does not recognize “Do-Not-Track” requests.

If you are a resident of any of the states listed above, you may have the right under applicable local data protection laws to exercise the following rights regarding your personal information, subject to certain exceptions and limitations:

for certain categories of personal information, the right to request a list of what personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties;

You may designate an authorized agent to make a request on your behalf. You can do this by authorizing your agent to access your ClassPass account and making a request on your behalf by contacting us as explained in the “How to Contact Us” section. Before responding to your request, we must first verify your identity using the personal information you recently provided to us. You must provide us with your full name and email address. We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your identity, or where necessary to process your request. If we are unable to verify your identity after a good faith attempt, we may deny the request and, if so, will explain the basis for the denial. We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws.
